I know that SIFT is patented.  Not sure about SURF.

  Maybe OpenCV has got such features, in which case you could extend the
opencv plugins in gst-plugins-bad to re-use those features.
  Else... you'll have to find another library implementing those and
wrap them as a GStreamer plugin (like the library Bert linked to in this
thread).

  Would be indeed interesting to have as gstreamer plugins,
